注：《企業(yè)境外投資管理辦法》（發(fā)改委第11號(hào)令）中：

（1）實(shí)行核準(zhǔn)管理的范圍是投資主體直接或通過(guò)其控制的境外企業(yè)開(kāi)展的“敏感類項(xiàng)目”，而“敏感類項(xiàng)目”包括涉及敏感國(guó)家和地區(qū)的項(xiàng)目和涉及敏感行業(yè)的項(xiàng)目；

（2）中央管理企業(yè)含中央管理金融企業(yè)、國(guó)務(wù)院或國(guó)務(wù)院所屬機(jī)構(gòu)直接管理的企業(yè)。

注意主管部門對(duì)敏感國(guó)家和地區(qū)、敏感行業(yè)的區(qū)別：

屬于核準(zhǔn)、備案管理范圍的項(xiàng)目，投資主體在取得有效核準(zhǔn)文件或備案通知書(shū)之前，外匯管理、海關(guān)等有關(guān)部門依法不予辦理相關(guān)手續(xù)，金融企業(yè)依法不予辦理相關(guān)資金結(jié)算和融資業(yè)務(wù)”。這就意味著商委和發(fā)改委的核準(zhǔn)/備案均為資金出境的前置條件。
