根據(jù)法律規(guī)定，營業(yè)執(zhí)照是法律主體進(jìn)行市場交易主體資格的法定證明，目前有法人類營業(yè)執(zhí)照、個人獨(dú)資企業(yè)營業(yè)執(zhí)照、合伙企業(yè)營業(yè)執(zhí)照和個體工商戶營業(yè)執(zhí)照等；營業(yè)執(zhí)照由工商局頒發(fā)，每年年檢。而經(jīng)營許可證，是法律規(guī)定的某些行業(yè)必須經(jīng)過許可，而由主管部門辦法的許可經(jīng)營的證明，如煙草專賣許可等。營業(yè)執(zhí)照是每個開門做生意的經(jīng)營者都需要辦理的證件，沒有這個證件，就是無照經(jīng)營行為，是違法的。經(jīng)營許可證是做某種方面的生意所必須取得的證件，這個證件必須在辦理營業(yè)執(zhí)照之前取得，也就是所謂的前置許可審批文件，例如賣煙的話，需要在辦營業(yè)執(zhí)照之前取得《煙草零售經(jīng)營許可證》，賣食品需要在辦營業(yè)執(zhí)照之前取得《食品流通許可證》，開飯店，搞餐飲服務(wù)的，需要在辦營業(yè)執(zhí)照之前取得《餐飲經(jīng)營許可證》，不一而就。
